Information notice on the processing of personal data (Article  13 Legislative Decree 196/2003)

 

Pursuant to Article 13 of Legislative Decree 30 June 2003, No 196 “Data Protection Code” (“Code”), Ponzano Children S.r.l., with registered office at Via Villa Minelli n. 1, Ponzano Veneto, Treviso, (“Ponzano Children”), in its capacity as Data Controller pursuant to Article 4 of the Code, provides users of the website www.ponzanochildren.com  (the “Website”) the following information on the use of personal data.

 

a) Source of the data and type of data processed.

The personal data processed by Ponzano Children is collected directly from Website users, by their registration to the services offered (e.g. the newsletter). Just navigating through the Website without subscribing to any online service may result in acquisition of information in a completely anonymous way. The Website uses cookies to collect information on how users use the web pages. Information (such as the type of browser used, whether a banner was clicked on, or nationality of the server used by the computer) is collected through cookies in order to make site navigation more efficient.

b) Data controller:

The Data controller is Ponzano Children S.r.l. having its registered office at Via Villa Minelli n. 1, Ponzano Veneto, Treviso, Italy.
c) Processing purposes:

The personal data collected on the registration forms for Website services and/or any information collected as part of the navigation process, including any sensitive data of which Ponzano Children may come into possession in relation to specific operations arranged by the user or particular services requested by the user (e.g. registration to the Newsletter) will be processed for the following purposes:

 

(i) fulfilment of statutory obligations, such as those provided by laws and regulations, European Union laws and any instructions laid down by the  authorities including the Supervisory Authority;

(ii) management of relationships with users, in Italy and abroad, by way of entry of the data in Ponzano Children’s IT systems;

(iii) sending of information on Ponzano Children’s services, also by e-mail or other electronic means.

 

Pursuant to Articles 24.1.b) and 43.1.b) of the Code, consent for processing in relation to the purposes indicated at point (i) is not required.

Conversely, the interested party should express consent to data processing (excluding sensitive data) for the purposes indicated at points  (ii)  and (iii) in the specific box on the registration form.

 

d)Data processing methods :

With reference to the purposes listed under point c), data processing, including the operations indicated under the definition of “processing” set forth in Article 4 of the Code (such as collection, registration, processing, extraction, comparison, communication and cancellation), will be performed with the aid of manual and automated instruments, for which Ponzano Children has adopted suitable security measures in order to ensure the integrity and confidentiality of said data.

 

e) Mandatory/optional nature of data provision.

Providing information is not mandatory. Nevertheless, failure to provide the information listed on the form to register for services or other personal information that may be requested for handling the contractual relationship may make it impossible for Ponzano Children to establish and/or continue the contractual relationship, in whole or in part, or to provide the requested services.

 

f) Parties to whom the data may be communicated or that may become aware of it:

 

Personal information may be communicated to:

(i) other companies in the Benetton Group (when the information is loaded into the company’s computer system);

(ii)  external companies that Ponzano Children may use to manage the contractual relationship with customers or for its own organizational and business needs. Such companies may be specialized in: (a) services for the acquisition, registration and processing of data; (b) IT services and management of Ponzano Children’s IT system and telecommunications networks (including e-mail). These parties will preserve customer personal information as independent data controllers or may become aware of such data as external data processors when specifically appointed to do so pursuant to Article 29 of the Code. Your personal information may be disclosed to their employees and co-workers, including free-lancers – specifically charged with data processing (with selected access based on the function performed) – belonging to services and offices of Ponzano Children and the Benetton Group carrying out technical, support and corporate control activities.

 

The list of the external data processors or independent data controllers will be kept up to date and made available at the registered office of Ponzano Children.

 

g) Rights pursuant to Article 7 of the Code:

In relation to the processing of personal information, based on Article 7 of the Code, data subjects have the right at any time to request confirmation of the existence or non-existence of their data, know its content and source, verify its accuracy or request its integration, update or correction.

 

Pursuant to the aforesaid Article, they have the right to request cancellation, transformation into an anonymous form or block of any information processed in breach of the law, and in any case to oppose to such  processing for legitimate reasons.
